02 Our Services

Geek Dental Marketing provides digital marketing services to dental practices, which may include brand development, website design and development, search engine optimization, paid advertising, social media content and management, and related services. The specific scope, deliverables, and fees for any engagement are defined in a separate proposal, service agreement, or order accepted by both parties, which controls if it conflicts with these Terms.

03 SMS / Mobile Messaging Terms

Program Name. Geek Dental Marketing LLC (the “Program”).

Program Description. When you opt in, you may receive text messages such as appointment reminders, confirmations, account and service notifications, customer support replies, and — where you have separately consented — marketing and promotional messages. Message frequency varies.

  • Opt-out. You can cancel the SMS service at any time. Simply text STOP to our number. After you send STOP, we will send a confirmation message, and you will no longer receive SMS messages from us.
  • Rejoining. If you wish to rejoin, sign up again as you did initially, and we will resume sending SMS messages to you.
  • Help. If you experience any issues with the messaging program, reply with the keyword HELP for assistance, or contact us at [PHONE NUMBER] or info@geekdentalmarketing.com.
  • Carrier liability. Carriers are not liable for delayed or undelivered messages.
  • Message and data rates. Message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies. For questions about your text or data plan, contact your wireless provider.
  • Privacy. For information about how we handle your data, please review our Privacy Policy.

Compliance with industry standards. Our messaging program is operated in accordance with applicable carrier requirements, CTIA guidelines, and industry standards for A2P messaging. Legal compliance. We comply with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and other applicable laws governing electronic communications.

04 Email Communications

By providing your email address, you consent to receive transactional and, where you have opted in, marketing emails from us. Every marketing email includes an unsubscribe link, and you may opt out at any time. We honor opt-out requests promptly in accordance with the CAN-SPAM Act.

05 Payments & Billing

Fees, payment schedules, and billing terms for our services are set out in your applicable proposal or service agreement. Recurring subscriptions are billed on the cycle stated in that agreement until cancelled in accordance with its terms. Unless otherwise stated in writing, fees are non-refundable once work has commenced.

06 Client Responsibilities & Acceptable Use

You agree to provide accurate information, to cooperate as reasonably needed for us to perform our services, and to use our website and services lawfully. You may not use our website or services to transmit unlawful, infringing, or harmful content, or in any way that violates applicable laws or third-party rights.

07 Intellectual Property

All content on our website — including text, graphics, logos, and the Geek Dental Marketing name and brand marks — is owned by or licensed to us and is protected by applicable intellectual property laws. Ownership of deliverables created for a specific client engagement is governed by the applicable service agreement.

08 No Guarantee of Results

Marketing outcomes depend on many factors outside our control, including market conditions, competition, and your practice’s own operations. While we apply our experience and best efforts, we do not warrant or guarantee any specific result, ranking, lead volume, patient count, or revenue. Any figures or examples we share are illustrative and are not a promise of performance.

09 Limitation of Liability

To the fullest extent permitted by law, Geek Dental Marketing will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue, arising out of or relating to your use of our website or services. Our total liability for any claim will not exceed the amount you paid to us for the services giving rise to the claim during the three (3) months preceding the event.

10 Indemnification

You agree to indemnify and hold harmless Geek Dental Marketing and its owners, employees, and contractors from any claims, damages, liabilities, and expenses arising out of your breach of these Terms, your misuse of our services, or your violation of any law or third-party right.

11 Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida.

We may update these Terms from time to time; the “Last Updated” date above reflects the latest version. Continued use of our website or services after changes take effect constitutes acceptance of the revised Terms.
